Version 1.0-draft — template document; review with licensed counsel before launch.
What Tap & Toast is
Tap & Toast operates a technology and marketplace booking platform that connects customers with third-party bartenders, mobile bar providers and venues nationwide across the United States. In Nashville & Middle Tennessee, our founding market, Tap & Toast may itself provide bartending service under its own packages. That first-party service is distinct from, and separately identified from, third-party listings booked through the platform.
Requests, not confirmed bookings
Submitting a request through this site is a request for service, not a confirmed booking. A booking is confirmed only once accepted in writing (and, for first-party Tap & Toast bookings, once the deposit is received).
Third-party providers and venues
Third-party bartenders, mobile bar providers and venues listed on the platform are independent businesses. They are responsible for their own acts, omissions, legal compliance, licensing, insurance, premises, staff, alcohol service and taxes, unless a separate written Tap & Toast service contract states otherwise. Listings and self-reported credentials shown on the platform are not endorsements or guarantees; you must independently evaluate whether a provider or venue is suitable for your event.
No guarantees
We do not guarantee availability, safety, legal compliance, revenue, event outcomes, provider performance, venue condition, or uninterrupted access to the platform.
Alcohol service
Tap & Toast provides bartending service only. The host supplies all alcohol unless otherwise arranged in writing. We provide ice, mixers, garnishes and service ware as described in your package.
Federal, state and local alcohol laws — including dram-shop and social-host laws — vary by jurisdiction. Nothing on this site is legal advice. See our Alcohol Service & Responsible Service Disclaimer for more detail.
Limitation of liability
This section is a placeholder pending review and approval by licensed U.S. counsel; it is not represented as enforceable in every jurisdiction. To the extent permitted by law, Tap & Toast's liability for claims arising from use of the platform is limited as set out in a final version of these terms. These limitations do not apply where prohibited by law, and nothing here waives liability for gross negligence, willful misconduct, or any right that cannot be waived under applicable law.
Indemnification
This section is a placeholder pending review and approval by licensed U.S. counsel; it is not represented as enforceable in every jurisdiction. Users, providers and venues may be asked to indemnify Tap & Toast for claims arising from their own acts or omissions, subject to a final reviewed version of this clause.
Dispute resolution and governing law
This section is a placeholder pending review and approval by licensed U.S. counsel; it is not represented as enforceable in every jurisdiction. A final version of these terms will specify the governing law and dispute-resolution process that applies to platform use.
Changes
We may update these terms. The version published here at the time of your use is the one that applies. Questions: hello@tapandtoastusa.com.
