Bartender Provider Agreement
Version 1.0-draft — template document; review with licensed counsel before launch.
Independent providers
Bartenders and mobile bar businesses listed on Tap & Toast are independent businesses. Listing on the marketplace is not employment, and it does not make a provider an agent, partner or joint venturer of Tap & Toast. Providers set their own prices and contract directly with the client for the services they perform.
Provider responsibilities
- Hold and maintain any licenses, permits and insurance your service requires in the jurisdiction where you work.
- Respond to leads and booking requests promptly and professionally.
- Serve responsibly and never to anyone under 21 or visibly intoxicated.
- Keep client information confidential and use it only for the lead it relates to.
- Comply with applicable federal, state and local alcohol laws, including any dram-shop or social-host obligations that apply to your service.
- Be accurate and truthful in listing information and credentials.
Listings are self-reported
Credentials, licenses, insurance and reviews shown on a provider profile are self-reported by the provider. A listing is not an endorsement or guarantee by Tap & Toast that the provider is licensed, insured, background-checked or otherwise qualified. Customers must independently evaluate a provider's suitability.
Membership and billing
- Plans are billed in advance through a secure hosted payment page.
- Lead volumes and service-area limits are set by the plan you choose.
- Cancel any time before your next billing date; months already paid are not refunded.
- Leads are not guaranteed to convert; plans buy access, not bookings.
Removal from the marketplace
We may pause, suspend or remove a listing for unprofessional conduct, repeated non-response, unsafe service, misrepresentation, or a report we determine warrants review. Where we remove a member without cause, we refund the unused portion of that month.
Limitation of liability and indemnification
This section is a placeholder pending review and approval by licensed U.S. counsel; it is not represented as enforceable in every jurisdiction. These limitations do not apply where prohibited by law and do not waive liability for gross negligence, willful misconduct, or non-waivable rights.
